Terms of Service

1. Agreement to Terms
By accessing or using the Effara platform and website ("Services"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Description of Services
Effara provides an AI-powered automation platform for insurance brokerages. Our Services include document processing, AI-assisted analysis, workflow automation, and related tools accessible through our web platform and API.
3. Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the Services or related systems.
- Reverse engineer, decompile, or disassemble any aspect of the platform.
- Use the Services to transmit malware, spam, or harmful content.
- Share account credentials with unauthorized parties or exceed your licensed seat count.
5. Your Data
You retain all rights to the data you upload to Effara ("Customer Data"). We process Customer Data solely to provide the Services as described in our Privacy Policy and Data Processing Agreement.
We do not use Customer Data to train AI models. This commitment is contractually enforceable through the DPA included with every customer agreement.
6. AI-Generated Outputs
Effara uses artificial intelligence to assist with document analysis, data extraction, and workflow automation. While we strive for accuracy, AI-generated outputs should be reviewed by qualified professionals before being relied upon. Effara does not guarantee the accuracy, completeness, or suitability of any AI-generated output.
You are responsible for reviewing and approving all outputs before they are sent to carriers, clients, or other third parties.
7. Fees and Payment
Fees for the Services are set out in your subscription agreement or order form. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' written notice before your next billing period.
8. Intellectual Property
Effara and its licensors own all intellectual property rights in the platform, including software, algorithms, interfaces, documentation, and trademarks. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services during the subscription term.
9. Availability and Support
We target 99.9% uptime for the platform and provide support during business hours. Specific SLA terms are set out in your customer agreement. We may perform scheduled maintenance with reasonable advance notice.
10. Limitation of Liability
To the maximum extent permitted by law, Effara's total liability arising out of or related to these Terms shall not exceed the fees you paid in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Termination
Either party may terminate the agreement as set out in the customer agreement. Upon termination, we will delete or return your Customer Data within 30 days, in accordance with your DPA. Sections that by their nature should survive termination will remain in effect.
12. Governing Law
These Terms are governed by the laws of Norway. Any disputes arising from these Terms shall be resolved by the courts of Oslo, Norway.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the platform at least 30 days before they take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
